Extending the application of the Administrative Policy Related to First Nation Approval for all Registration Plans
Coming in force: March 1st, 2010
Commencing with all Instructions issued on or after March 1st, 2010, for the preparation of all Registration Plans on First Nation Lands, the Office of the Surveyor General of Canada Lands will require that Surveyors obtain an approval in writing from the First Nation Band Council or an appropriately designated representative (i.e. Band Lands Manager) that the plan is satisfactory. Acceptable methods of indicating approval include a signed formal letter, a Band Council resolution, or a signed approval form.
Provisional returns must include a copy of the approval in one of the prescribed formats. Surveyors are responsible for supplying their clients with any and all copies of final registration plans, as appropriate, after they have been recorded in the Canada Lands Surveys Records.
On June 1, 2006, the Office of the Surveyor General of Canada Lands made it the responsibility of Canada Lands Surveyors to obtain an approval in writing from the First Nation Band Council or an appropriately designated representative (i.e. Band Lands Manager) that "Indirect" Registration Plans are satisfactory (see accompanying document).
In the continuing interest of promoting a closer working relationship between First Nations and the surveying profession, the Surveyor General of Canada Lands is now further delegating the responsibility for obtaining First Nation approvals for "Direct" Registration Plans to the Surveyor responsible for the plan. "Direct" Registration Plans are those that are paid for by the government of Canada under contracts administered by the Surveyor General Branch, Natural Resources Canada. The following policy has the effect of delegating the above mentioned responsibility for all Registration Plans.
